Use Permit, Site Plan, Architecural Review at 375
PROJECT: Application to the Planning Commission for a Site Plan to develop the site at 375 Hollow Way with a restaurant business; a Use Permit for outdoor dining space and a drive-through feature; and a Demolition for removal of the existing 640 sq ft structure. The proposed building will be 1,627 sq ft with 360-feet of outdoor patio dining. The applicant is also proposing a drive-through window on the east side. Business hours are proposed to be Monday through Saturday 6AM to 6PM.
The property is encumbered with a deed restriction by the Regional Water Quality Control Board (RWQCB) which restricts property uses due to soil contamination from the Pioneer Reduction Works, which produced waste products that included chloritizing tailings that were disposed on the property. The RWQCB has preliminarily indicated its permission of the proposed restaurant use contingent upon the application providing engineer-certified drawings that verify that construction will not affect the containment cell, in a letter dated January 30, 2020
The property is within a base zoning district of Local Business (LB) which allows for a restaurant involving outdoor components with a Conditional Use Permit. The business will be served by NID water and Nevada City sewer. Only minimal grading will be necessary in order to accommodate proper drainage of the site. The project site is also designated within the City’s Scenic Corridor, applied to land adjacent to roads and highways, whereby the Planning Commission may impose special conditions or design features in consideration of the project.
